Anti-SPAM Policy
Internet Marketing Plus has a zero tolerance for SPAM abuses. Not only is sending SPAM against the law in
the United States of America, but it is also a nuisance, and a hinderance to the proper marketing
practices employed by IMP. This document will explain our policy regarding SPAM in detail.
Definition
SPAM (a.k.a. UCE - Unsolicited Commercial E-mail) is unsolicited, irrelevant, or inappropriate Internet
messages, especially (but not limited to) commercial advertising in mass quantities. Such venues
whereby one can SPAM include, but are not limited to: e-mail, newsgroups, BBS (discussion forums),
and instant messenger systems.
SPAM-Related Practices
Internet Marketing Plus considers the following practices to be SPAM, and does not condone these practices
in conjunction with the marketing tools provided by us.
- Sending e-mail to anyone who has not specifically requested e-mail from you.
- Purchasing e-mail lists from a third party, even if the third party claims that the people on the
list requested to receive industry-related information.
- Sending e-mail to anyone via a third party that references our company or website, especially any such
references that could result in your receiving referral credits.
- Newsgroup or BBS (discussion forum) posts irrelevant to the topic being discussed that contain references
to our company or website, or any such posts that are posted in violation of that newsgroup/forum's
usage terms.
- Advertising or otherwise references our company or website in any instant messages sent to people
that do not know you or that did not specifically request such information from you.
E-mail Requirements
All members who utilize our services agree to be bound by any and all SPAM laws/regulations in force by their
government, in addition abiding by the CAN-SPAM
Act passed by the Congress of the United States
in 2003. This Act requires the following:
- True and accurate sender information that must identify the person who initiated the e-mail.
- Subject lines that are relevant to the message content.
- An opt-out method, which is automatically added to every message sent through our Autoresponder system,
but which must also be included in any message you send through a third-party (including
yourself) that references our company or website.
- All commercial e-mails must be identified as commerical. This is also automatically added to every message
sent through our Autoresponder system, but again, you must also include it in any message
sent outside of our system that references our company or website.
- Your valid, physical postal address must be included in every message. This, too, is automatically added
to every message sent through our Autoresponder system, but you must also include it in any
message sent outside of our system that references our company or website.
Penalties for Non-Compliance
Internet Marketing Plus reserves to right to, at our sole discretion, determine whether a member is in violation
of this policy. In addition to any penalties imposed by your government (as all instances of
SPAM will be reported to the appropriate government agency), we reserve the
right to impose the following penalties for failure to comply:
- Immediate termination of your account, including the loss of all associated data, the forfeiture of all
commissions and other monies owed, and the refusal of a refund.
- Reporting of your SPAM activities to your Internet Service Provider, and any other companies we deem
appropriate to inform.
- A "Clean Up and Recovery Fee", the amount of which Internet Marketing Plus retains the sole
right to determine. Such a determination will be based, in part, on the amount of time
and effort required to restore (or attempt to restore) the integrity of our system and service.
This fee shall be no less than $300 USD, and will be billed to the offending member's account.
- Any and all other remedies afforded by U.S. law.
